Phillip E. Foco is a partner in our firm where he has been practicing law since 1998.  Mr. Foco specializes in defending employers and insurers against work place injury claims both in District Court and in the Office of Workers' Compensation.  Mr. Foco also specializes in the defense of redhibition and warranty claims for the manufactured housing industry.  Additionally, Mr. Foco has experience litigating matters related to subsurface gas storage in salt domes.

Mr. Foco graduated magna cum laude from LSU in 1995 with a Bachelor of Science degree in Psychology and a minor in English.  While at LSU, Mr. Foco served as President of  Phi Eta Sigma National Honor Society and was also a member of Phi Beta Kappa and Phi Kappa Phi Honor Societies.  Mr. Foco received his Juris Doctorate from the LSU Law Center in 1998 and joined the firm that same year.  He is admitted to practice before all Louisiana state courts and agencies, and the U.S. District Courts for the Middle, Eastern and Western Districts of Louisiana.  Mr. Foco is a member of the Louisiana State Bar Association, the Baton Rouge Bar Association, the Defense Research Institute and the Manufactured Housing Institute.

Mr. Foco's recent notable professional accomplishments include

  • Lead counsel for the Dow Chemical Company, Union Carbide Corporation, Stonetrust Commercial Insurance Company, MMR Group, Inc., Hollywood Casino, and Triad Electric and Controls on workers' compensation litigation throughout the State of Louisiana; 
  • Lead counsel for Champion Enterprises, Inc., and Platinum Homes, LLC, on redhibition and warranty litigation;
  • Lead counsel representing chemical manufacturer in complex toxic exposure litigation filed in District Court by a former on-site contractor.  Litigation involved extensive expert testimony in the fields of air-modeling, toxicology and immunology.  The litigation resulted in dismissal of the claim by summary judgment and affirmation of the dismissal on appeal to the Louisiana Fifth Circuit;
  • The successful and cost effective defense of entity engaged in CERCLA mandated remediation in litigation filed by workers of neighboring facilities alleging toxic exposure caused by remediation activities;
  • The successful defense of an owner of a subsurface gas storage facility against unlawful trespass claims filed by neighboring land owners.  The litigation resulted in dismissal of the claim by summary judgment and affirmation of the dismissal on appeal to the United States Fifth Circuit, Eastern District;
  • Currently involved in multi-million dollar commercial litigation related to the catastrophic failure of a subsurface gas storage facility;  
  • Extensive experience pursuing claims for reimbursement against third party torfeasors and the State of Louisiana's Second Injury Fund on behalf of employers and insurers that have paid workers' compensation benefits.

Mr. Foco has a wife and two daughters and currently serves on the Board of Directors for Volunteer Baton Rouge.
