Pre-filed Bills of Note for the 2026 Louisiana Legislative Session
The 2026 Fiscal Session of the Louisiana Legislature begins on March 9, 2026. Be on the lookout for our posts in the coming weeks about a number of closely watched pre-filed bills. In the tort realm, legislators are pushing additional reform measures. For instance, Representative Boyer introduced House Bill No. 118 seeking to cap general damages in personal injury litigation to $5 million. The bill would enact La. R.S. 22:1899 to cap all general damages at $5 million post-verdict. Under the current version of the bill, the cap will not be disclosed to the jury.
Representative Chenevert is sponsoring House Bill 240 to amend the litigation financing provisions under La. R.S. 9:3580.13. The amendments seek to limit the recovery of a litigation financer and ensure that recovery does not exceed the amount netted by the plaintiff after recovery is reduced by costs and attorney’s fees. The bill also requires attorneys to provide a copy of any litigation financing agreements to their client within thirty days of the agreement’s effective date.
Representative Green is sponsoring House Bill No. 281 to require automobile liability insurers to disclose insurance policy information to third-party claimants with certain parameters.
Finally in the personal injury arena, Senator Morris is sponsoring Senate Bill No. 67 seeking to enact La. Civil Code article 2315(C). The provision seeks to define a compensable mental anguish or emotional distress claim absent a physical injury. Under the current version of the bill, such a cause of action would require evidence of the defendant’s “outrageous” conduct and be supported by competent medical evidence.
