Pre-filed Bills of Note for the 2026 Louisiana Legislative Session: Part 2

Continuing the discussion of proposed legislation in the upcoming 2026 Fiscal Session of the Louisiana Legislature, Representative Landry introduced House Bill No. 135, which proposes to amend La. R.S. 13:3881 to increase the equity value of a motor vehicle not subject to seizure/garnishment and exempt an additional motor vehicle (same amount) if debtor is married or whose household has a child that is a licensed driver. Importantly, the bill would also exempt Health Savings Accounts from seizure/garnishment.

Louisiana is currently a “one party consent” state when it comes to recording conversations. Representative Schlegel seeks to change this rule with House Bill No. 410, which would require notification and consent of all participating parties to record a conversation when the parties have a reasonable expectation of privacy. The bill contains certain exceptions relative to law enforcement.

Senator Hodges introduced Senate Bill No. 72, which would enact La. R.S. 32:714 to provide for/permit the use of electronic signatures in connection with motor vehicle transactions (transfer, sale, titling, registering, encumbrance). The bill seeks to modernize and streamline the vehicle transaction process.

In proposed Senate Bill No. 223, Senator Luneau seeks to enact La. R.S. 14:39.3 to establish the crime of failure to test for alcohol/controlled substances on the part of motor carriers subject to 49 CFR 382 where there is an accident resulting in serious bodily injury or death of another person.  If passed, those in violation would be subject to a fine of up to $25k and/or prison for up to one year. Regulations pertaining to commercial motor vehicles predominantly fall within the scope of the Federal Motor Carrier Safety Regulations.
